1. Purpose of These Child Safety Standards
These Child Safety Standards (“Standards”) set out the rules, procedures, and commitments of Whimscope, LLC (“WHIMSCOPE”, “the Company”, “we”) regarding the protection of children from sexual abuse and exploitation on the WHIMSCOPE Platform, including the mobile application published on Google Play and on the Apple App Store under the name “Whimscope: Fun Things to Do”, as well as the website https://whimscope.com (collectively, the “Platform”). The developer and publisher of the application is Whimscope, LLC, 131 Continental Dr, Suite 305, Newark, DE 19713, New Castle County, Delaware, United States.
WHIMSCOPE explicitly prohibits child sexual abuse and exploitation (CSAE) in any form and maintains a zero-tolerance policy toward child sexual abuse material (CSAM) and any conduct that sexualizes, exploits, grooms, or endangers minors.
The purpose of these Standards is to clearly state what content and conduct are prohibited, to explain how users can report concerns, to describe how WHIMSCOPE responds to such reports, and to confirm our compliance with applicable child safety laws and the child safety policies of the platforms through which the application is distributed, including the Google Play Child Safety Standards policy and the Apple App Store Review Guidelines.
These Standards form an integral part of the WHIMSCOPE Terms of Use and must be interpreted together with the Community Guidelines, Community Safety Policy, Acceptable Use Policy, User Generated Content Policy, Content Moderation and Enforcement Policy, and Privacy Policy.
2. Scope and Definitions
These Standards apply to all users of the Platform, all user-generated content (including profiles, photos, videos, activities, comments, and messages), all interactions between users through Platform features, and any activities proposed, created, or organized by users through the Platform.
For the purposes of these Standards, the following definitions apply:
- “Minor” or “child” means any person under the age of 18, or under the age of majority in the applicable jurisdiction, whichever is higher;
- “Child sexual abuse and exploitation” (CSAE) means any conduct that sexually abuses or exploits a minor, including, without limitation, the production, distribution, or possession of CSAM, grooming, sextortion, the sexualization of minors, live-streamed abuse, child sex trafficking, and the solicitation of a minor for sexual purposes;
- “Child sexual abuse material” (CSAM) means any visual depiction, including photographs, videos, computer-generated or AI-generated images, drawings, or animations, of sexually explicit conduct involving a minor, as well as any material that otherwise sexualizes a minor;
- “Grooming” means establishing contact with or building trust with a minor, or with persons responsible for a minor, with the intent of engaging the minor in sexual activity or producing sexualized content;
- “Sextortion” means threatening or coercing a minor to obtain sexual content, sexual activity, money, or other benefits;
- “Sexualization of a minor” means depicting, describing, or presenting a minor in a manner that emphasizes sexual characteristics or portrays the minor as an object of sexual interest.
3. Minimum Age and Access to the Platform
The Platform is not intended for individuals under the age of 13 (or under a higher minimum age required by the laws of the user’s jurisdiction). Users must meet the minimum age requirement to create an account, publish content, or participate in Platform activities.
WHIMSCOPE applies age-related measures in accordance with the Terms of Use and the Community Safety Policy. If WHIMSCOPE becomes aware that an account belongs to a user who does not meet the minimum age requirement, the Company may restrict or delete such account and the associated content.
Users aged 13 to 17 who are permitted to use the Platform under applicable law are subject to additional protective measures under the Community Guidelines, and WHIMSCOPE may apply stricter moderation to content and interactions that may affect the safety or well-being of such users.
4. Prohibited Content and Conduct
WHIMSCOPE strictly prohibits any content, activity, or behavior that constitutes, facilitates, promotes, or normalizes child sexual abuse or exploitation.
Without limiting the foregoing, users are prohibited from:
- uploading, publishing, sharing, storing, requesting, or linking to CSAM in any form, including computer-generated, AI-generated, animated, or drawn material;
- publishing or distributing content that sexualizes minors, including sexualized comments, captions, descriptions, or activity ideas involving minors;
- grooming, or attempting to groom, a minor, including initiating or maintaining contact with a minor for sexual purposes;
- engaging in sextortion or any form of threat, coercion, or blackmail against a minor;
- soliciting, offering, or arranging sexual contact with a minor, or using the Platform to organize or promote offline activities intended to sexually abuse or exploit a minor;
- facilitating, advertising, or promoting child sex trafficking or the sexual exploitation of minors in any way;
- sharing instructions, tips, or advocacy relating to the sexual abuse or exploitation of minors, or expressing support for such conduct;
- using the Platform to identify, contact, or collect personal data of minors for the purpose of abuse or exploitation;
- publishing sexual, violent, or otherwise harmful content in a manner that may be accessible to minors;
- creating accounts, profiles, or content that impersonate minors for sexual purposes.
Any of the above conduct constitutes a material violation of these Standards, the Terms of Use, the Community Guidelines, and the Acceptable Use Policy, regardless of whether the content is public, private, or shared directly between users.
5. Prevention and Detection
WHIMSCOPE takes reasonable technical and organizational measures to prevent and detect CSAE on the Platform, including:
- content moderation, which may combine automated tools and human review, in accordance with the Content Moderation and Enforcement Policy;
- automated detection and hash-matching technologies designed to identify known CSAM, where such technologies are available to the Company;
- review of user reports and complaints concerning the safety of minors as a matter of priority;
- restrictions on account features and content visibility where there is a reasonable suspicion of a violation of these Standards;
- internal procedures and training for personnel involved in content moderation and handling of child safety reports.
WHIMSCOPE is not obligated to conduct continuous monitoring of all user content or communications; however, the Company reserves the right to review content and activity at any time for the purpose of protecting minors and ensuring compliance with these Standards and applicable law.
6. Reporting Child Safety Concerns
WHIMSCOPE provides users with the ability to report content, accounts, or conduct that may violate these Standards directly within the application. Users may submit a report through the reporting (“Report”) feature available on user profiles, activities, comments, and other user-generated content, as well as through the in-app support and feedback features.
Reports concerning the safety of minors may also be submitted by email to WHIMSCOPE at support@whimscope.com. Anyone, including non-users, parents, legal guardians, and organizations, may submit such a report.
When submitting a report, users are encouraged to provide as much relevant information as possible, including the username or link to the account, a description of the content or conduct, the date and approximate time of the incident, and any other details that may assist the review.
Users must not download, store, forward, or re-share suspected CSAM, including for the purpose of reporting. Reports should describe or link to the content rather than reproduce it.
Reports relating to the safety of minors are treated as a priority and are reviewed as promptly as reasonably possible. WHIMSCOPE does not require the reporting person to identify themselves and does not disclose the identity of the reporting person to the reported user.
If a child is in immediate danger, users should contact local law enforcement or emergency services first. In the United States, reports may also be submitted directly to the National Center for Missing & Exploited Children (NCMEC) CyberTipline at https://report.cybertip.org.
7. Handling of Reports and Enforcement
Upon receiving a report or otherwise becoming aware of a possible violation of these Standards, WHIMSCOPE reviews the relevant content, account, and circumstances in accordance with the Content Moderation and Enforcement Policy.
Where WHIMSCOPE determines that content or conduct violates these Standards, the Company may take any of the following measures, without prior notice to the user:
- immediate removal of the content or restriction of access to it;
- immediate and permanent termination of the user’s account and any related accounts;
- prevention of the creation of new accounts by the same person;
- preservation of the relevant content, account information, and related data for the purposes of reporting to the competent authorities and complying with legal obligations;
- reporting to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement authorities as described in Section 8.
Given the severity of CSAE violations, WHIMSCOPE applies a zero-tolerance approach: a single confirmed violation is sufficient for permanent account termination. Appeals concerning enforcement actions taken under these Standards are handled in accordance with the Content Moderation and Enforcement Policy; however, WHIMSCOPE is not obligated to restore content or accounts removed for CSAE violations.
8. Reporting to Authorities and Cooperation with Law Enforcement
Whimscope, LLC is a company organized under the laws of the State of Delaware, United States. In accordance with applicable United States federal law, including 18 U.S.C. § 2258A, WHIMSCOPE reports apparent CSAM and other instances of CSAE of which it becomes aware to the National Center for Missing & Exploited Children (NCMEC) through the CyberTipline.
WHIMSCOPE preserves the content and related account data connected with such reports for the period required by applicable law and provides such information to NCMEC and law enforcement authorities in accordance with legal requirements.
WHIMSCOPE cooperates with law enforcement authorities and other competent governmental bodies in the United States and other jurisdictions, including by responding to lawful requests, subpoenas, and court orders, and may provide information about users, content, or activities relating to the safety of minors without prior notice to the user, as further described in the Community Safety Policy and the Privacy Policy.
Where a violation involves users located in other countries, WHIMSCOPE may report the matter to the relevant national authorities or hotlines and cooperate with international organizations engaged in the protection of children.
9. Compliance with Child Safety Laws
WHIMSCOPE complies with applicable laws and regulations relating to the protection of children, including United States federal laws concerning CSAM and the reporting obligations of online service providers, the Children’s Online Privacy Protection Act (COPPA), and the relevant laws of other jurisdictions in which the Platform is available.
WHIMSCOPE also complies with the child safety requirements of the platforms through which the application is distributed, including the Google Play Developer Program Policies (Child Safety Standards policy) and the Apple App Store Review Guidelines, and will update these Standards as necessary to reflect changes in such requirements.
The processing of personal data in connection with the detection, review, and reporting of CSAE, including the retention of evidence and the disclosure of information to NCMEC and law enforcement authorities, is carried out on the basis of the Company’s legal obligations and legitimate interests in ensuring the safety of the Platform, as described in the Privacy Policy.
